PLEASE READ THESE TERMS CAREFULLY BEFORE USING PAIN POINT ENGINE. BY ACCESSING OR USING THIS SERVICE YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SERVICE.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Pain Point Engine ("Company", "we", "us", "our") governing your access to and use of the Pain Point Engine platform, website, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.
Pain Point Engine is a market research and intelligence tool that aggregates publicly available information from third-party platforms including but not limited to Reddit, Hacker News, Stack Overflow, GitHub, G2, Capterra, Upwork, DuckDuckGo, and Google Trends, and applies artificial intelligence analysis to summarise and score that information. The Service is provided for informational and research purposes only.
You must be at least 16 years of age to use this Service. By using the Service you represent and warrant that you meet this requirement. Users under 18 must have parental or guardian consent. We reserve the right to terminate accounts that we believe belong to users who do not meet eligibility requirements.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials. You may not share your account with others or create multiple accounts to circumvent usage limits.
The Free plan provides limited access to the Service at no charge, subject to usage restrictions including search limits. We reserve the right to modify Free plan limits at any time without notice.
The Pro plan is billed monthly at $29.00 USD per month. Billing occurs on the same date each month from the date of initial subscription. You may cancel at any time and will retain Pro access until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
The Lifetime plan is available for a one-time payment of $279.00 USD (discounted from $300.00). This plan provides access to all current Pro features and all future features added to the Lifetime tier for the duration that the Service remains operational. The Lifetime plan is non-refundable after 14 days from purchase. See Section 9 for our refund policy.
We reserve the right to modify subscription prices. Existing Pro subscribers will receive 30 days' written notice before any price change takes effect. Lifetime plan holders will not be subject to price increases on features included at time of purchase.
All payments are processed by Stripe, Inc. By providing payment information, you authorise us to charge your payment method for applicable fees. You represent that you are authorised to use the payment method provided.
You agree not to use the Service to:
Violation of this Acceptable Use Policy may result in immediate account termination without refund.
The Service, including its software, design, algorithms, trademarks, and all original content created by us, is owned by Pain Point Engine and protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from our proprietary content without express written permission.
The Service aggregates and summarises publicly available content from third-party platforms. Pain Point Engine does not claim ownership of such content. All third-party content remains the property of its respective owners. We process this content under fair use principles for the purpose of commentary, criticism, and research summarisation.
You retain ownership of search queries and any content you submit to the Service. By using the Service, you grant us a limited, non-exclusive licence to process your queries solely for the purpose of delivering the Service to you.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAIN POINT ENGINE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
THE SERVICE PROVIDES MARKET RESEARCH INFORMATION ONLY. IT IS NOT FINANCIAL ADVICE, LEGAL ADVICE, BUSINESS ADVICE, OR INVESTMENT ADVICE. ANY BUSINESS DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE ARE MADE ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAIN POINT ENGINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR:
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Pain Point Engine and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or data you submit to the Service.
Monthly Pro subscriptions are non-refundable once a billing cycle has begun. You may cancel at any time to prevent future charges. If you experience a technical failure that prevents you from using the Service for more than 72 consecutive hours, you may request a prorated credit by contacting support within 30 days of the incident.
Lifetime plan purchases are eligible for a full refund within 14 days of purchase, provided you have not downloaded more than 5 reports. After 14 days, all Lifetime plan payments are final and non-refundable. To request a refund within the eligible window, contact us at support@painpointengine.zo.space.
No charges apply to the Free plan. No refunds are applicable.
We do not guarantee uninterrupted or error-free operation of the Service. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. For Lifetime plan holders, in the event of permanent Service discontinuation, we will provide at least 90 days' notice and a prorated refund based on time elapsed since purchase.
The Service integrates with and links to third-party platforms and services. These third parties are not under our control. We are not responsible for the content, privacy practices, or terms of service of any third-party platform. Your use of third-party services is governed by their respective terms and policies. We make no representations or warranties regarding third-party content surfaced through the Service.
The Service uses artificial intelligence to analyse, classify, score, and summarise information. AI-generated content, including severity scores, pain point classifications, and proposed solutions, is produced algorithmically and may contain errors, inaccuracies, or misleading information. AI-generated analysis does not constitute professional advice of any kind. You are solely responsible for independently verifying any information before acting on it. Pain Point Engine disclaims all liability for decisions made based on AI-generated outputs.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to the Service or other users, without prior notice and without liability to you. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, 14, and 16 of these Terms survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Tucson, Arizona under the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service and may request account deletion.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pain Point Engine regarding your use of the Service and supersede all prior agreements, representations, and understandings.
